Jereme Rucker, Appellant v. The State of Texas, Appellee

FROM THE 147TH DISTRICT COURT OF TRAVIS COUNTY
NO. D-1-DC-19-201667 , THE HONORABLE CHUCK MILLER, JUDGE PRESIDING ORDER

PER CURIAM

Appellant's brief on appeal was originally due on October 30, 2019. After appellant's original appointed counsel failed to respond to an overdue notice, the Court abated the case and remanded it to the trial court for a hearing under Texas Rule of Appellate Procedure 38.8. After the hearing, the trial court appointed appellant's current counsel, and the case was reinstated on January 21, 2020.

On current counsel's motions and this Court's May 20, 2020 Blanket Order Extending Time to File Briefs, the time for filing appellant's brief was extended to June 30, 2020. Appellant's counsel has now filed a fifth motion, requesting that the Court extend the time for filing appellant's brief. We grant the motion for extension of time and order appellant to file a brief no later than July 7, 2020. No further extension of time will be granted and failure to comply with this order will result in the referral of this case to the trial court for a hearing under Rule 38.8(b) of the Texas Rules of Appellate Procedure.

It is ordered on July 6, 2020. Before Justices Goodwin, Triana, and Smith Do Not Publish
