Appeal from a judgment of the District Court of Nassau County, First District (Gary F. Knobel, J.; op 28 Misc.3d 850, 905 N.Y.S.2d 490), entered June 18, 2010. The judgment, entered pursuant to an order granting defendants' motion for summary judgment, dismissed the action.
ORDERED that the judgment is affirmed, without costs.
For the reasons stated in Rozz v. Village Auto Body Works, Inc. (35 Misc.3d 13, 2012 N.Y. Slip Op 22035 [Appeal No.2010–2236NC], decided herewith), the judgment is affirmed.
