JUDGMENT


For the reasons set out in an Order filed contemporaneously with this Judgment,

IT IS ORDERED AND ADJUDGED that respondent's motion to dismiss this action for being filed after the expiration of the one-year limitation period contained in 28 U.S.C. § 2244(d)(1) (docket no. 6) is granted, that this action is dismissed, and that finding no substantial issue for appeal concerning the denial of a constitutional right affecting the conviction, nor a debatable procedural ruling, a certificate of appealability is denied.
