Opinion
Gen. No. 41,628. (Abstract of Decision.)
Opinion filed June 9, 1941
GARNISHMENT, § 10 — principal debtor, as not person to whom garnishee indebted. Garnishee was properly dismissed, where it appeared that judgment debtor was a corporation, but in a certain business transaction garnishee dealt with an individual who had formerly been associated with the corporation but who was conducting a business individually, garnishee took a guaranty against adulterating or misbranding goods involved from the individual and not the corporation, and although use by the individual of old corporation stationery was not commended because of its tendency to confuse, there was no question of an estoppel.
