Ross v. State

District Court of Appeal of Florida, First District
Nov 17, 1999
744 So. 2d 1241 (Fla. Dist. Ct. App. 1999)

Opinion

No. 99-108.

Opinion filed November 17, 1999.

An appeal from the Circuit Court for Bay County. Dedee S. Costello, Judge.

Nancy A. Daniels, Public Defender, and Dana M. Drukker, Assistant Public Defender, Tallahassee, for Appellant.

Robert A. Butterworth, Attorney General, Lori D. Stith, Assistant Attorney General, Tallahassee, for Appellee.

Appellant argues that the trial court erred in assessing 36 community sanction violation points, instead of 12, on his sentencing guidelines scoresheet upon his violation of community control, which he was serving concurrently in three cases. We agree for the reasons expressed in Brown v. State, 24 Fla. L. Weekly D2322 (Fla. 1st DCA Oct. 4, 1999). Accordingly, we VACATE the sentence and REMAND for resentencing with an accurate scoresheet.

BOOTH, MINER and KAHN, CONCUR.
