Ross v. State

Supreme Court of Florida
Nov 28, 2022
No. SC20-1386 (Fla. Nov. 28, 2022)

Opinion

SC21-926

11-28-2022

SHAMEL J. ROSS Petitioner(s) v. STATE OF FLORIDA Respondent(s)

Lower Tribunal No(s).: 3D21-1136; 132018CF0251540001XX; 132012CF0292570001XX; 132012CF0291010001XX

Petitioner was ordered to show cause why the Court's decision in Spear v. State, 341 So.3d 1106 (Fla. 2022), is not controlling in this case and how it impacts the Court's decision on jurisdiction. In light of Petitioner's failure to respond to the order to show cause, the Court has determined that it should decline to accept jurisdiction in this case. See Spear v. State, 341 So.3d 1106 (Fla. 2022). The petition for discretionary review is, therefore, denied.

No motion for rehearing will be entertained by the Court. See Fla. R. App. P. 9.330(d)(2).

MUÑIZ, C.J., and LABARGA, COURIEL, GROSSHANS, and FRANCIS, JJ., concur.

HON. ROBERT THOMAS WATSON, JUDGE
