Judgment and order reversed upon the law and the facts, and new trial granted, costs to appellant to abide the event, upon the ground that an issue of fact was presented for the jury. Young, Kapper and Seeger, JJ., concur; Rich and Hagarty, JJ., dissent and vote to affirm.
