Ross v. 110 Glen Street Realty Corp.

Appellate Division of the Supreme Court of New York, Third Department
Mar 12, 1952
279 App. Div. 953 (N.Y. App. Div. 1952)

Opinion

March 12, 1952.

Appeal from Supreme Court, Warren County.

Present — Foster, P.J., Heffernan, Brewster, Bergan and Coon, JJ.

The sole point at issue is whether the requirements of section 205 Gen. Bus. of the General Business Law apply to the absentee owner of a hotel. Since the statute was passed in the interest of public safety we think its command is absolute against all those named therein ( Yall v. Snow, 201 Mo. 511). Judgments and orders unanimously affirmed, without costs.
