Rosenzweig v. Dime Savings Bank of Williamsburg

Appellate Division of the Supreme Court of New York, Second Department
Jun 1, 1921
198 App. Div. 914 (N.Y. App. Div. 1921)

Opinion

June, 1921.

The real ownership of this bank deposit and how far it was known to Mr. Rosenzweig seem doubtful, and we, therefore, afford the plaintiff a new trial. Hence the judgment and findings numbered 4, 5 and 6, are severally reversed, with the conclusion of law, as against the weight of the evidence, and a new trial is granted, with costs to appellant to abide the event. Blackmar, P.J., Mills, Rich, Putnam and Jaycox, JJ., concur.
