Judgment modified by inserting therein a direction for a nonsuit of plaintiff's cause of action, except as to the item of thirty dollars and sixty-five cents, the amount paid for freight and cartage, for which judgment was directed in favor of the plaintiff against the defendant, and as thus modified the judgment is affirmed, without costs of this appeal to either party. All concurred.
