DECISION AND ORDER ON MOTION

Motion to strike supplemental record on appeal and portions of the brief of appellant, for costs and for extension of time to file and serve brief of respondent..

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion to strike the supplemental record on appeal is granted, without costs, and the supplemental record is hereby deemed stricken, and it is further

ORDERED that the motion to strike portions of the brief of appellant is granted, without costs, only to the extent that any references to the supplemental record on appeal are hereby stricken. Appellant shall file and serve a corrected brief on or before November 1, 2017. It is further

ORDERED that the motion for costs is denied, without costs, and it is further

ORDERED that the motion for an extension of time to file and serve the brief of respondent is denied, without costs, and without prejudice to renewal upon the issuance of a scheduling memorandum.
