Supreme Court of Pennsylvania
Jan 7, 1935
176 A. 216 (Pa. 1935)

Opinion

November 26, 1934.

January 7, 1935.

Trusts and trustees — Jurisdiction — Trusts inter vivos — Orphans' courts — Courts of common pleas — Acts of June 26, 1931, P. L. 1384, and June 7, 1917, P. L. 363.

The jurisdiction over trusts inter vivos conferred upon the orphans' court by the Act of June 26, 1931, P. L. 1384, amending section 9 of the Act of June 7, 1917, P. L. 363, is concurrent with that of the courts of common pleas.

Argued November 26, 1934.

Before FRAZER, C. J., SIMPSON, KEPHART, SCHAFFER, MAXEY, DREW and LINN, JJ.

Appeal, No. 77, Jan. T., 1935, by William Buechley, Jr., petitioner, from decree of C. P. Schuylkill Co., March T., 1933, No. 143, in Estate of Frank Roseberry, late trustee, deceased.

Petition and rule to set aside appointment of trustee. Before HOUCK, J.

The opinion of the Supreme Court states the facts.

Rule discharged. Petitioner appealed.

Error assigned was discharge of rule, quoting record.

John B. McGurl, for appellant.

Chas. E. Berger, for appellee.

The sole question raised by this appeal is whether the Act of June 26, 1931, P. L. 1384, (amending section 9 of the Orphans' Court Act of 1917, P. L. 363) repeals the Act of 1828, P. L. 453, in so far as it relates to trusts inter vivos, and vests in the orphans' courts exclusive jurisdiction of the appointment of substituted trustees in such cases. If there was any doubt as to this matter, it has been resolved by our decision in the case of Schwartz v. Schwartz, 316 Pa. 318, in which we adopted in toto the opinion of the lower court which expressly stated that the jurisdiction over trusts inter vivos conferred upon the orphans' courts by the Act of 1931, supra, is concurrent with that of the courts of common pleas.

The decree is affirmed at appellant's costs.
