On order of the Court, the application for leave to appeal from the June 28, 2001 order of the Court of Appeals is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for consideration as on leave granted. The Court of Appeals is directed to determine the proper level of scrutiny to be applied to plaintiff's equal protection claim, and whether MCL 722.712(1) violates that standard. Crego v Coleman, 463 Mich. 248 (2000); Geduldig v Aiello, 417 U.S. 484 (1974). The Court of Appeals shall render its decision by October 1, 2002.
