Rose v. First National Bank of Miami

District Court of Appeal of Florida, Third District
Sep 9, 1971
251 So. 2d 547 (Fla. Dist. Ct. App. 1971)

Opinion

Nos. 70-1284, 71-23.

June 29, 1971. Rehearing Denied September 9, 1971.

Appeals from Circuit Court for Dade County; Harold R. Vann, Judge.

Gustafson Caldwell and Bryson K. Lovejoy, Ft. Lauderdale, for appellant.

Snyder, Young Stern, and Joseph Teichman, No. Miami Beach, for appellee.

Before PEARSON, C.J., and CHARLES CARROLL and SWANN, JJ.

These appeals are from separate judgments in two proceedings each seeking distribution of income of a testamentary trust to a vested remainderman. The appeals were argued together. The trial court denied the claimed right to distribution and we affirm. See Mahan v. Lummus, 160 Fla. 505, 35 So.2d 725 (1948); Weed v. Knox, 157 Fla. 896, 27 So.2d 419 (1946).
