Opinion

Case No. 96-2953

Opinion filed December 26, 1996. Rehearing Denied January 29, 1997

An appeal under Florida Rule of Appellate Procedure 9.140(g) from the Circuit Court for Dade County, Leslie Rothenberg, Judge.

Alberto Antonio Rosales, Jr., in proper person.

Robert A. Butterworth, Attorney General, for appellee.

Before SCHWARTZ, C.J., and NESBITT and FLETCHER, JJ.

We grant the petition for writ of Habeas Corpus for leave to seek a belated appeal of the denial of Rosales' 3.800 motion for credit for time served. See Russell v. State, 652 So.2d 448 (Fla. 3d DCA 1995). Reviewing the order on the merits, we affirm. Sims v. State, 441 So.2d 187 (Fla. 5th DCA 1983); see Hopping v. State, 650 So.2d 1087 (Fla. 3d DCA 1995).
