It appearing to the Court that it is without jurisdiction, the Petition for Review is hereby dismissed. See Davis v. Mandau, 410 So.2d 915, 915 (Fla. 1981) (holding that a district court's summary affirmance on a particular issue was "effectually an affirmance without opinion with which express and direct conflict cannot be established").

No motion for rehearing will be entertained by the Court.

WELLS, QUINCE, CANTERO and BELL, JJ., concur.

ANSTEAD, C.J., PARIENTE and LEWIS, J., would deny.
