Opinion

No. 04-03-00868-CV.

Delivered and Filed: May 12, 2004.

Appeal from the 131st Judicial District Court, Bexar County, Texas, Trial Court No. 2003-CI-04080, Honorable John D. Gabriel, Jr., Judge Presiding.

Dismissed.

Sitting: Alma L. LÓPEZ, Chief Justice, Karen ANGELINI, Justice, Sandee Bryan MARION, Justice.

MEMORANDUM OPINION

Appellant Robert Keith Romero's brief was originally due on February 17, 2004. We granted Romero an extension until March 18, 2004 to file the brief. Neither the brief nor a motion for extension of time has been filed.

Therefore, on March 31, 2004, we ordered Romero to file, on or before April 10, 2004, his appellant's brief and a written response reasonably explaining (1) his failure to timely file the brief and (2) why appellee is not significantly injured by his failure to timely file a brief. We warned that if Romero failed to file a brief and the written response by the date ordered, we would dismiss the appeal for want of prosecution. Despite our warning, Romero has failed to file his brief or file a written response. We, therefore, dismiss this appeal for want of prosecution. See Tex.R.App.P. 38.8(a).
