An appeal having been taken from an order of the Supreme Court, Bronx County, entered on or about October 17, 2019, and said appeal having been perfected, and plaintiff-respondent having moved to strike defendant-appellant's appendix or, in the alternative, to require defendant to file a corrected appendix, including certain exhibits listed by plaintiff in the moving papers, and for an adjournment of the appeal,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that the motion is granted to the extent of adjourning the appeal to the December 2020 Term and directing defendant-appellant to file a supplemental appendix, to include the missing exhibits set forth in Exhibit I to the moving papers, with costs to abide the appeal.
