ALEX ROJAS, Appellant, v. THE STATE OF TEXAS, Appellee.
Do not publish. TEX. R. APP. P. 47.2(b).
ON APPEAL FROM THE 23RD DISTRICT COURT OF MATAGORDA COUNTY, TEXAS
Before Justices Benavides, Tijerina, and Silva
ORDER
PER CURIAM
This cause is before the Court on appellant's failure to file the appellate brief. Appellant's brief was originally due on August 26, 2024. After two previous extensions, appellant's brief was due to be filed on November 15, 2024. On November 21, 2024, an Order was issued, and appellant was provided additional time to file a brief making appellant's brief due on or before 5:00 p.m. on November 26, 2024. On November 27, 2024, appellant filed a third extension of time to file the appellate brief. Appellant requests "that this Court grant this one, final, extension of time to file the brief, extending the deadline to the end of the day on Friday, November 29, 2024."
Appellant's counsel failed to timely file the brief. The Court looks with disfavor upon appellant's counsel's disregarding of its Order. IT IS THEREFORE ORDERED that the Honorable Allison Mathis, counsel for appellant, file the appellate brief due in this cause with this Court on or before 5:00 p.m. on December 2, 2024. If Allison Mathis fails to file appellant's brief with this Court as ordered, the Honorable Allison Mathis shall be ORDERED to appear in person at a date to be determined in the Courtroom of the Thirteenth Court of Appeals, located at the Nueces County Courthouse, 901 Leopard Street, Tenth Floor, in Corpus Christi, Texas, to show cause why she should not be held in contempt.
