KEVIN ANTONIO ROJAS-GALLO, Appellant v. THE STATE OF TEXAS, Appellee
On Appeal from the 283rd Judicial District Court Dallas County, Texas
Trial Court Cause Nos. F15-48215-T & F15-48216-T
ORDER
Section 22.011 of the Texas Penal Code defines "child" as "a person younger than 17 years of age." See TEX. PENAL CODE ANN. § 22.011(c)(1) (West 2013). Appellant was convicted of continuous sexual abuse of a young child and indecency with a child. When we determined that appellant's briefs, filed in each of the above appeals, identified the victim and other child witnesses by name, we ordered the briefs stricken and ordered appellant to refile the briefs using generic terms or initials to identify the victim and any other child witnesses. On August 11, appellant refiled the briefs. Although his amended briefs identify the victim and certain child witnesses by initials, he still refers to another child witness by name.
Accordingly, we STRIKE appellant's amended briefs filed August 11, 2017.
We ORDER appellant to file, within FIFTEEN DAYS of the date of this order, amended briefs that identify any child witness or child victim either generically ("victim") or by initials only.
We DIRECT the Clerk to send copies of this order to Allan Fishburn and the Dallas County District Attorney's Office.
