JOE Y. ROGERS, III, Appellant v. SANDRA ROGERS MILLER, AS INDEPENDENT ADMINISTRATOR WITH WILL ANNEXED OF THE ESTATE OF JOE Y. ROGERS, JR., Appellee

On Appeal from the County Court at Law No. 4 Williamson County, Texas
Trial Court Cause No. 17-0461-CP4A

MEMORANDUM OPINION

This is an interlocutory appeal from an order denying a special appearance signed November 21, 2019. The notice of appeal was due December 11, 2019. See Tex. R. App. P. 26.1. Appellant, however, filed his notice of appeal on December 23, 2019, a date within 15 days of the due date for the notice of appeal. See Verburgt v. Dorner, 959 S.W.2d 615, 617 (Tex. 1997). Appellant did not file a motion to extend time to file the notice of appeal.

On April 7, 2020, we ordered appellant to file a proper motion to extend time to file the notice of appeal on or before April 17, 2020. See Tex. R. App. P. 26.3, 10.5(b). Appellant did not file a motion. We, therefore, dismiss the appeal. See Tex. R. App. P. 42.3.

Appellant's motion to extend time to file his brief is denied as moot.

PER CURIAM Panel consists of Justices Christopher, Wise, and Zimmerer
