Appeals having been taken to this Court from an order of the Supreme Court, New York County, entered on or about March 28, 2022, And defendants-appellants-respondents, 4 Third Avenue Leasehold LLC and 4 Third Avenue Fee LLC, having moved, pursuant to 22 NYCRR 1250.10(c), to vacate the dismissal of their appeal, and, upon vacatur, for an extension of time to perfect same (Motion No. 2022-04916),
And third-party defendant-respondent-appellant, Tri Star Construction Corp., having moved, pursuant to 22 NYCRR 1250.10(c), to vacate the dismissal of their appeal, and, upon vacatur, for an extension of time to perfect same (Motion No. 2022-04918), And third-party defendants-respondents-appellants, Par Fire Protection Company, Par Plumbing Protection Company, and The Par Group, having moved for an extension of time in which to perfect their appeal (Motion No. 2022-05070), Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon, It is ordered that the motions are granted to the extent of vacating the dismissals and reinstating the appeals taken to this Court by 4 Third Avenue Leasehold LLC and 4 Third Avenue Fee LLC (Motion No. 2022-04916) and Tri Star Construction Corp., (Motion No. 2022-04918), and extending the time in which to perfect said appeals along with the appeal taken to this Court by Par Fire Protection Company, Par Plumbing Protection Company (Motion No. 2022-05070), to the June 2023 Term of this Court.
