The parties agree that the case is moot, and it appears to the Court that the case became moot before the Court of Appeals decision was issued. The motion is allowed. The petition for review is dismissed as moot. The decision of the Court of Appeals, 210 Or App 620,152 P3d 938 (2007) is vacated as moot.
