Rodriguez v. State

District Court of Appeal of Florida, Third District
Apr 11, 2001
782 So. 2d 966 (Fla. Dist. Ct. App. 2001)

Opinion

No. 3D00-3637.

Opinion filed April 11, 2001.

An Appeal under Fla.R.App.P. 9.141(b)(2) from the Circuit Court for Miami-Dade County, Peter R. Lopez, Judge. Lower Tribunal No. 98-42097.

Reversed and Remanded with instructions.

Javier Rodriquez, in proper person.

Robert A. Butterworth, Attorney General, and Michael J. Neimand, Assistant Attorney General.

Before COPE, GERSTEN, and GREEN, JJ.

The State correctly agrees that the trial court erred in issuing an order under case number 98-42097, which denied the defendant's motion to correct illegal sentence filed in case number 98-42068. Accordingly, we reverse and remand with instructions to the trial court to consider the motion under the correct case number, which is circuit court number 98-42068.
