Rodriguez v. State

District Court of Appeal of Florida, Third District
May 17, 2000
No. 3D99-1258 (Fla. Dist. Ct. App. May. 17, 2000)

Opinion

No. 3D99-1258.

Opinion filed May 17, 2000.

An Appeal conducted pursuant to Anders v. California, 386 U.S. 738 (1967), from the Circuit Court for Dade County, Ellen L. Leesfield, Judge L.T. No. 98-36806.

Victor Rodriguez, in proper person.

Robert A. Butterworth, Attorney General, for appellee.

Before JORGENSON, LEVY, and FLETCHER, JJ.

Victor Rodriguez appeals from a judgment of conviction and sentence as a Violent Career Criminal under section 775.084, Florida Statutes (1995). We find no merit to the arguments relating to the appeal of the convictions. However, we reverse the sentence imposed and remand for resentencing, as the sentence entered was unlawful. See State v. Thompson, 750 So.2d 643 (Fla. 1999).

Affirmed in part; reversed in part; remanded.

NOT FINAL UNTIL TIME EXPIRES TO FILE REHEARING MOTION AND, IF FILED, DISPOSED OF.
