ORDERED that the motion to dismiss the appeal from the order of Supreme Court dated October 23, 2012 is granted, without costs, and it is further

ORDERED that the motion to dismiss the appeal from the order of Supreme Court dated April 5, 2013 is denied, without costs, and without prejudice to the issue involved being raised upon the argument of the appeal.
