Order

On order of the Court, the application for leave to appeal the April 21, 2022 judgment of the Court of Appeals is considered. We direct the Clerk to schedule oral argument on the application. MCR 7.305(H)(1). The parties shall address whether the Court of Appeals correctly interpreted MCR 3.501(A)(5) to mean that, where a statute provides for a minimum penalty irrespective of actual damages, no class action may be maintained on the basis of that statute, including a class action for actual damages and equitable relief, unless the statute expressly provides otherwise.

The Michigan Bankers Association and the Consumer Law Section of the State Bar of Michigan are invited to file briefs amicus curiae. Other persons or groups interested in the determination of the issue presented in this case may move the Court for permission to file briefs amicus curiae.
