ROBERT RODRIGUEZ, Appellant v. SCOTT GINSBURG, Appellee

On Appeal from the 366th Judicial District Court Collin County, Texas
Trial Court Cause No. 366-04978-2015

ORDER

Before the Court is appellant's December 27, 2018 motion to abate the appeal. In his motion, appellant explains the trial court signed the summary judgment on August 4, 2017. Following a timely-filed motion to reconsider, the trial court vacated its judgment by order signed on November 16, 2017. The trial court's November 16th order includes a handwritten notation that the trial court "will rule by submission on 12/1/17 or after." Appellant asks this Court to abate this appeal for thirty days to allow the trial court to issue a further order. We GRANT the motion.

We DIRECT the Clerk of this Court to send a copy of this order to the Honorable Ray Wheeles, Presiding Judge of the 366th Judicial District Court, and all parties.

We ABATE the appeal. It will be reinstated in thirty days from the date of this order.
