On May 13, 2024, respondent filed with the Court a Motion to Dismiss for Failure to Properly Prosecute. On May 21, 2024, the Court ordered petitioner to file a Response to Motion to Dismiss for Failure to Properly Prosecute by May 28, 2024.

This case was called and recalled from the calendar of the Court's June 3, 2024 Atlanta, Georgia Trial Session. There was no appearance by or on behalf of petitioner. Counsel for respondent appeared and was heard. Respondent counsel was heard on the Motion to Dismiss for Failure to Properly Prosecute.

Upon due consideration, and for cause more fully appearing in the transcript, it is

ORDERED that petitioner shall, on or before June 24, 2024, show cause in writing why respondent's May 13, 2024 Motion to Dismiss for Failure to Properly Prosecute should not be granted and a decision entered. It is further

ORDERED that in addition to regular service, the Clerk of the Court shall serve a copy of respondent's motion to dismiss and a copy of this Order to the following address: Kevin S. Romero Rodriguez, 376 Sancho Drive, Lawrenceville, GA 30044. It is further

ORDERED that jurisdiction is retained by the Undersigned.
