This case was called from the calendar of the Court's December 18, 2023, trial session for Los Angeles, California. There was no appearance by or on behalf of petitioner. Respondent appeared and was heard. On November 17, 2023, respondent filed with the Court a Motion to Dismiss for Lack of Prosecution. Upon due consideration, and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that respondent's November 17, 2023, Motion to Dismiss for Lack of Prosecution is granted, and this case is hereby dismissed for lack of prosecution. It is also

ORDERED AND DECIDED that there is no deficiency in income tax due from petitioner, and no penalty due pursuant to I.R.C. § 6662 for the taxable year 2019.
