This case was calendared for trial at the Court's New York City, New York trial session, which was scheduled to begin June 13, 2022. On May 16, 2022, respondent filed a First Supplement to Order Court's April 6, 2022 Order to Show Cause asking the Court to dismiss the case as no deficiency will be assessed. On May 19, 2022, the Court served an order striking the case from the calendar and giving the parties until June 17, 2022 to file either a signed decision document or file a status report apprising the Court of the then-present status of the case. On June 16, 2022, respondent filed a status report indicating that computations were still needed and they requested more time to receive and process the computations. On June 17, 2022, the Court served an order giving the parties until August 1, 2022 to file either a signed decision document or file a status report apprising the Court of the then-present status of the case. On August 1, 2022, respondent filed a Status Report indicating to the Court that respondent has prepared a draft of a decision document to be mailed to petitioner, however, computations have not yet received. Additionally, there is a premature assessment on petitioner's account that must be abated. Respondent requested sixty days to process everything and submits a signed decision document. Upon due consideration, it is hereby
ORDERED that, on or before October 3, 2022, the parties shall submit to the Court either a stipulated decision or file a joint report (or separate reports, if preferred) regarding the then-present status of this case.
