ORDER

By order of September 5, 2023, the application for leave to appeal the March 2, 2023 judgment of the Court of Appeals was held in abeyance pending the decision in Milne v. Robinson (Docket No. 164190). On order of the Court, the case having been decided on March 20, 2024, 513 Mich. 1 (2024), the application is again considered and, pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we VACATE Parts II(A) and II(C) of the judgment of the Court of Appeals and REMAND this case to that court for reconsideration of plaintiff's negligent entrustment and owner's liability claims in light of Milne.

Bernstein, J., did not participate because he has a family member with an interest that could be affected by the proceeding.
