CYZE RODGERS, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 265th Judicial District Court Dallas County, Texas
Trial Court Cause No. F18-75588-R

ORDER

Before the Court is appellant's June 19, 2020 motion to set briefing schedule. In the motion, appellant notes that the Court ordered a supplemental clerk's record to be filed by June 24, 2020. Appellant asks we set a deadline for filing appellant's brief.

Rule 38.6 of the rules of appellate procedure provides that appellant must file a brief within 30 days after the later of (1) the date the clerk's record was filed or (2) the date the reporter's record was filed. The reporter's record has been filed, and a portion of the clerk's record has been filed. Once the supplemental clerk's record is filed, appellant's brief will be due thirty days after that date (i.e., thirty days after the date the supplemental clerk's record is filed).

We GRANT appellant's motion to the extent we ORDER appellant's brief due thirty days after the supplemental clerk's record is filed as provided by rule 38.6.
