ORDER
After making an independent review of the pleadings, files, and records in this case, and the April 5, 2005 findings and recommendation of the magistrate judge, the court concludes that the findings and conclusions are correct and are therefore adopted. Accordingly, defendants' November 10, 2004 motion for summary judgment is granted to the extent that plaintiff's federal-law claims are dismissed with prejudice. The court declines in its discretion to consider his state-law claims, and it dismisses them without prejudice.
Because the court is deciding a motion for summary judgment, it has not adopted any findings of fact.
