The appellants have filed an emergency motion requesting the entry of a temporary stay of further proceedings in the trial court pending the resolution of their interlocutory appeal. Because this interlocutory appeal concerns the resolution of a threshold issue-specifically, whether the trial court erred in denying the appellants' motion to compel arbitration-that should be decided before the parties expend further resources on non-jurisdictional issues, this court hereby GRANTS the emergency motion staying all further trial-court proceedings until this court has finally disposed of the interlocutory appeal. See Tex. R. App. P. 29.3 ("When an appeal from an interlocutory order is perfected, the appellate court may make any temporary orders necessary to preserve the parties' rights until disposition of the appeal and may require appropriate security."); see also In re State, No. 24-0325, 2024 WL 2983176, at *2 (Tex. June 14, 2024) (construing Rule 29.3 as allowing court of appeals to stay trial-court proceedings to preserve parties' rights); see, e.g., Sam Houston Elec. Coop. v. Berry, 582 S.W.3d 282, 287 (Tex. App.-Beaumont 2017, no pet.) (stating that court of appeals granted emergency motion to stay trial-court proceedings pending disposal of interlocutory appeal from order denying motion to compel arbitration).
