ORDER
Pursuant to Tex.R.App.P. 10.4 (a) the motion ruled on through this Order may have been decided by a single Justice sitting on the panel.
Before the Court is Appellant Michael L. Cass's motion for leave to file a supplemental letter brief to address recent Texas Supreme Court precedent in Occidental Permian, which was not available at the time Appellant's brief was submitted. Occidental Permian, Ltd. v. Citation 2002 inc. LLC, No. 23-0037, 2024 WL 2226281 (Tex. May 17, 2024). The motion is GRANTED.
A letter brief not to exceed 2,500 words is due on or before June 24, 2024. The letter brief is limited to addressing the Occidental Permian opinion. Pursuant to Texas Rule of Appellate Procedure 38.7, all parties may submit a similar letter brief due to be filed on or before June 24, 2024. Tex.R.App.P. 38.7 (allowing supplemental briefing if justice so requires).
