February Term, 1897.
It appearing that there are not four justices of the Appellate Division, in the fourth judicial department, who "are qualified to sit herein" and take part in the decision of the appeals brought into the fourth Appellate Division in this case, it is now ordered and directed that the appeals in this case be and the same are hereby "sent to the third judicial department, to be there heard and determined." Either party is authorized to give notice to bring on the argument of said appeals in the Appellate Division of the third judicial department. All concurred, except Follett, J., not sitting.
