ORDER

Before the Court is appellant's May 8, 2020 motion to supplement the record on appeal and hold the briefing schedule in abeyance. The record shows the current case was tried on a reindictment. Appellant was originally indicted under cause no. F13-56450 and seeks to supplement the record in the current case with the record developed in cause no. F13-56450. We GRANT in part and DENY in part the motion.

We ORDER the Dallas County District Clerk to file, within THIRTY DAYS of the date of this order, a supplemental clerk's record containing the clerk's record from appellant's original case filed as cause no. F13-56450.

We also ORDER the Dallas County District Clerk to file, within THIRTY DAYS of the date of this order, a supplemental clerk's record containing (1) appellant's February 19, 2020 request for the appellate record from the court reporter, (2) appellant's February 19, 2020 designation of the clerk's record, and (3) the trial court's certification of appellant's right to appeal.

We ORDER Official Court Reporter Darline King LaBar to determine which court reporter would have reported any proceedings in cause no. F13-56450 and to coordinate the filing, within THIRTY DAYS of the date of this order, of either (1) a supplemental reporter's record of any proceedings held in cause no. F13-56450 or (2) written verification that no proceedings were reported in cause no. F13-56450.

We DENY that portion of appellant's motion seeking an abeyance of the briefing schedule. Instead, we EXTEND the time to file appellant's brief until SIXTY DAYS from the date of this order.

We DIRECT the Clerk of the Court to transmit copies of this order to the Honorable Tracy Homes, Presiding Judge, 363rd Judicial District Court; the Dallas County District Clerk; Official Court Reporter Darline King LaBar; and counsel for the parties.
