Robinson v. State

District Court of Appeal of Florida, Fourth District
Oct 27, 1993
625 So. 2d 991 (Fla. Dist. Ct. App. 1993)

Opinion

No. 92-2597.

October 27, 1993.

Appeal from the Circuit Court for Broward County; Mark A. Speiser, Judge.

Richard L. Jorandby, Public Defender, and Allen J. DeWeese, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Dawn S. Wynn, Asst. Atty. Gen., West Palm Beach, for appellee.

We affirm as to all issues except the conviction and sentence for battery. The state concedes that the trial court failed to instruct the jury as to the elements of the crime of battery. We therefore reverse and remand for a new trial on that issue.

GUNTHER, WARNER and FARMER, JJ., concur.
