MEMORANDUM OPINION

Opinion By Justice FitzGerald
Before the Court is appellee's motion to dismiss the appeal. Appellee contends the appeal should be dismissed because appellant has failed to pay the filing fee or pay for the clerk's record. By letter dated December 1, 2011, the Court notified appellant that the $175 filing fee was past due. The Court told appellant to pay the required fee within ten days or her appeal would be dismissed. As of today's date, appellant has not paid the filing fee.
By letter dated January 6, 2012, the Dallas County Clerk informed the Court that the clerk's record had been prepared and would be filed once payment was received from appellant. The Court sent appellant a letter on January 9, 2012 giving her ten days to provide either proof of payment for the clerk's record or proof that she is entitled to proceed without payment of costs. As of today's date, appellant has not responded.
Accordingly, we grant appellee's motion and dismiss the appeal. See Tex. R. App. P. 37.3(b) & 42.3(c).
