MEMORANDUM AND ORDER


On April 3, 2004, plaintiffs filed and served interrogatories and requests for production of documents. Defendants did not respond. On September 8, 2004, this court granted plaintiffs' motion to compel, and directed the defendants to respond to plaintiffs' discovery requests within 10 days. They have not done so. On September 22, 2004, plaintiffs filed a motion for sanctions, requesting a default judgment and an award of counsel fees. The defendants have failed to respond.

Given this procedural history, one can only conclude that the defendants no longer intend to contest this matter. Default judgment will therefore be entered, and further proceedings will be limited to the determination of damages and counsel fees.

An Order follows.

ORDER

AND NOW, this 7th day of January 2005, upon consideration of plaintiffs' repeated motions for sanctions, and defendants' failure to respond, IT IS HEREBY ORDERED:

1. As to liability, JUDGEMENT is ENTERED in favor of the plaintiffs and against the defendants.
2. Further proceedings shall be limited to the determination of damages and counsel fees.
