Robinson v. City of Detroit

Supreme Court of Michigan
May 28, 1998
457 Mich. 876 (Mich. 1998)

Opinion

No. 110330.

Decided May 28, 1998.

Summary Dispositions May 28, 1998:

In lieu of granting leave to appeal, the May 23, 1997, unpublished memorandum opinion of the Court of Appeals is vacated, and the case is remanded to that Court for reconsideration. MCR 7.302(F)(1). The record indicates that the Wayne Circuit Court did not grant summary disposition on the basis of the "two-inch rule," but rather on the basis of the "half-inch rule" adopted in Zielinski v. Szokola, 167 Mich. App. 611 (1988), lv den 432 Mich. 859 (1989). Jurisdiction is not retained.

Court of Appeals No. 194356.
