ORDER


The motion of Defendant Dorothy Shepherd to Vacate Default Judgment (Docket No. 61) is pending for determination by the undersigned. The relevant background is identical to that set forth by the undersigned in the March 14, 2005 Memorandum Opinion and Order filed in Whittaker v. District of Columbia, et al., Civil Action No. 01-1403 (Docket No. 96). Similarly, the arguments of the Attorney General, D.C., and of the plaintiff are identical to those offered in Whittaker, except that in the instant action, the Attorney General, D.C., failed to file a reply to plaintiff's opposition to the motion. Finally, the authorities applicable here are also identical to those which the undersigned applied in the determination of the identical motion filed by the Attorney General, D.C., in Whittaker. Accordingly, the background, discussion and findings set forth by the undersigned in Whittaker are fully incorporated herein by reference.

It is therefore ORDERED, for the same reasons set forth in the March 14, 2005 Memorandum Opinion and Order filed inWhittaker, that the Motion of Defendant Dorothy Shepherd to Vacate Default Judgment filed in this action is DENIED.
