MEMORANDUM ORDER


Before the Court is a Motion for Summary Judgment (Document No. 16) filed by the Defendant, United States Attorney General John Ashcroft. The motion was filed on September 19, 2001. The Plaintiff, who is proceeding pro se, filed on

October 2, 2001, Plaintiff's Motion for Summary Judgment (Document No. 20). There is no Certificate of Service attached to Plaintiff's motion. The court is unable to ascertain whether Document No. 20 is Plaintiff's Answer to Defendant's Motion for Summary Judgment or whether it's a Cross-Motion for Summary Judgment.

Plaintiff shall, within seven (7) days of the date of this Order, inform the Court, as well as counsel for the Defendant, whether Document No. 20 filed October 2, 2001, is intended to be an answer to Defendant's previously filed Motion for Summary Judgment (Document No. 16). If Document No. 20 is intended to be a Motion for Summary Judgment, Defendant has fourteen (14) days after service to respond to the Motion. In either event, Plaintiff must send Defendant a copy of Document No. 20 within seven (7) days of the date of this Order.
