Opinion

No. 94-31.

April 7, 1995.

Appeal from the Circuit Court for Volusia County; John W. Watson, III, Judge.

James B. Gibson, Public Defender, and Brynn Newton, Asst. Public Defender, Daytona Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Belle B. Turner, Asst. Atty. Gen., Daytona Beach, for appellee.

We affirm Robert's judgment and sentence for strong-armed robbery. However, we strike the special condition of probation requiring payment of $84.00 to First Step of Volusia County. See Tibero v. State, 646 So.2d 213 (Fla. 5th DCA 1994).

§ 812.13(1) and (2)(c), Fla. Stat. (1993).

AFFIRMED in part; REMANDED to Strike Condition of Probation.
