ORDER

Christian N. Weiler, Judge.

On July 24, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution as to Petitioner Barbara Work, Deceased. The motion states that Barbara Work passed away in Mexico sometime in 2020, which date is subsequent to the filing of the Petition in this case. Respondent also states that Barbara Work, deceased, is survived only by her spouse, petitioner Robert Eugene Work, and that Robert Eugene Work does not object to the granting of the motion.

The premises considered, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is granted in that this case is dismissed for lack of prosecution as to Barbara Work, deceased. It is further

ORDERED that the caption of this case is amended to read: "Robert Eugene Work, Petitioner v. Commissioner of Internal Revenue, Respondent". It is further

ORDERED that on or before September 21, 2023, respondent shall file a revised Proposed Stipulated Decision with the correct caption.
