ORDER


After making an independent review of the pleadings, files and records in this case, and the Findings, Conclusions and Recommendation of the United States Magistrate Judge, I am of the opinion that the findings and conclusions of the Magistrate Judge are correct and they are accepted as the findings and conclusions of the Court.

IT IS, THEREFORE, ORDERED that the findings, conclusions and recommendation of the United States Magistrate Judge are ACCEPTED and that Plaintiff's request for leave to proceed in forma pauperis is DENIED pursuant to the three strike provision of 28 U.S.C. § 1915(g). This action will be dismissed pursuant to the three-strike provision of § 1915(g) unless Plaintiff tenders the $150.00 filing fee within 30 days of the date of this order.

The Clerk shall MAIL a copy of this order to Plaintiff.
