Present — Dore, J.P., Cohn, Callahan, Van Voorhis and Shientag, JJ.


On condition that the case shall proceed to trial at the first available date, the order appealed from is unanimously modified by restraining defendants, pending the trial, with regard to the relief requested in items 1 and 2 of the order to show cause dated April 15, 1949, and in all other respects otherwise unanimously affirmed, without costs. No opinion. Settle order on one day's notice.
