Opinion

No. 363, 1998.

January 20, 1999.

Court Below — Court of Chancery of the State of Delaware, in and for New Castle County, C.A. No. 14663.

AFFIRMED.

Unpublished Opinion is below.

SCOTT ROBB, Defendant Below, Appellant, v. BELCOM, INC., Plaintiff Below, Appellee. No. 363, 1998. In the Supreme Court of the State of Delaware. Submitted: December 21, 1998. Decided: January 20, 1999.

Court Below — Court of Chancery of the State of Delaware, in and for New Castle County, C.A. No. 14663.

Before WALSH, HOLLAND and BERGER, Justices.

This 20th day of January, 1999, the Court having considered this matter on the opening brief filed by the appellant, and the motion to affirm filed by the appellee, has determined that: to the extent the issues raised on appeal are factual, the record evidence supports the trial judge's factual findings; to the extent the errors alleged on appeal are attributed to an abuse of discretion, the record does not support those assertions; and to the extent that the issues raised on appeal are legal, they are controlled by settled Delaware law, which was properly applied. Therefore, this Court has concluded that the judgment of the Court should be affirmed on the basis of and for the reasons assigned by the Court of Chancery in its decision dated July 15, 1998.

NOW, THEREFORE, IT IS HEREBY ORDERED that the judgment of the Court of Chancery be, and the same hereby is, AFFIRMED.

BY THE COURT:

/s/ Randy J. Holland, Justice
