By order dated August 21, 2023, this court notified the parties that it was abating the appeal and withdrawing the appeal from submission. We did so to allow the trial court to make findings of fact and conclusions of law and cause a supplemental clerk's record containing such to be filed with the Clerk of this Court. A supplemental clerk's record containing findings of fact and conclusions of law was filed on October 4, 2023. Therefore, this appeal is REINSTATED, and it is set for SUBMISSION on the previously filed briefs on January 26, 2024 before a panel consisting of Chief Justice Rebeca C. Martinez, Justice Luz Elena D. Chapa, and Justice Beth Watkins.
